This guideline has been commonly developed by the European industry associations CECE, CEMA, EGMF, EUnited Municipal Equipment, EUROMOT, Europgen and FEM to assist surveillance authorities in inspecting engines and non-road mobile machinery for their exhaust emissions under Regulation 2016/1628.
This guide is not legally binding and is intended to reflect the common view of the associations on the legal provisions of the Regulation. It describes the main elements relevant to market surveillance and provides practical information for inspections.
The Regulation requires EU Member States to establish or designate market surveillance authorities and to provide for effective and appropriate sanctions for infringements of this Regulation.
Economic operators must provide the documents and information which those authorities consider necessary for the pursuit of their activities. Self-propelled municipal machinery or equipment fitted with auxiliary engines fall under the scope of this legislation.
